1. General Provisions

1.1. These Terms of Use define the conditions of use of the energystate.ru website and of the information posted on it.

1.2. The owner of the website is the National Energy Security Fund (NESF), a limited liability company, PSRN 1057749192270, INN 7701630081, address: 8 bldg. 1, Sadovaya-Chernogryazskaya St., Moscow, 107078, Russia (floor 3, rooms 20, 21), e-mail: projects@energystate.ru.

1.3. A User is an individual or legal entity that accesses the website and uses the information posted on it and the available functions.

1.4. Use of the website means that the User has reviewed these Terms. These Terms do not replace a separate consent to the processing of personal data and do not constitute consent to receive advertising messages.

2. Purpose and Functionality of the Website

2.1. The website is intended for posting information about the activities of NESF, its materials, services, projects and other information related to the activities of the Company.

2.2. The User may review the open materials of the website and send enquiries by means of the available contact form.

2.3. These Terms provide neither for the creation of user accounts nor for the website's access to the camera, microphone, contact list, the user's geographic location or social media information, unless such functions are actually implemented and described in separate documents.

2.4. If new functions are implemented on the website in the future, the conditions of their use and the related personal data processing procedures must be reflected in the current documents of the website.

3. Use of Website Information

3.1. Website information is provided for the information of Users and for use within the limits permitted by the legislation of the Russian Federation.

3.2. The User must comply with the legislation of the Russian Federation, the rights of NESF and the rights of third parties.

3.3. Actions aimed at disrupting the operation of the website, gaining unlawful access to its information systems, circumventing the established access restrictions, distributing malicious software or otherwise unlawfully interfering with the operation of the website are not allowed.

4. Enquiries via the Website

4.1. The User may send an enquiry to NESF by means of the contact form, if such a form is available on the website.

4.2. The User determines the content of the message sent himself or herself and must not disclose the personal data of third parties without a lawful basis.

4.3. Before submitting the form, the User gives a separate consent to the processing of personal data in the manner prescribed by the Consent to the Processing of Personal Data for Website Forms posted on the website.

4.4. Sending an enquiry does not mean that the User consents to receive advertising messages.

5. Personal Data

5.1. The processing of the personal data of Users is carried out by NESF in accordance with Federal Law No. 152-FZ of 27.07.2006 "On Personal Data", the Personal Data Processing Policy of the National Energy Security Fund (NESF) and other applicable documents.

5.2. These Terms of Use do not constitute consent to the processing of personal data in the cases where the legislation or the chosen legal ground requires a separate consent of the subject.

5.3. When the contact form is used, personal data are processed to the extent and for the purposes specified in the separate Consent to the Processing of Personal Data for Website Forms.

5.4. If technical means that process user data are actually used on the website, information about this must be reflected in the Policy and in other applicable documents in accordance with the actual processing model.

6. Advertising Messages

6.1. These Terms do not contain the User's consent to receive advertising.

6.2. The sending of advertising messages over telecommunication networks is allowed only with the prior consent of the recipient, in the cases provided for by the legislation of the Russian Federation.

6.3. If NESF organizes advertising mailings with the use of personal contact data, the consent to such messages is executed separately from these Terms and from the consent used for regular enquiries via the website.

7. Intellectual Property Rights

7.1. The exclusive rights to the website materials belong to their right holders.

7.2. The use of texts, images, designations and other protected materials is allowed within the limits established by the legislation of the Russian Federation or with the permission of the respective right holder.

7.3. The posting of third-party materials on the website does not mean that the exclusive rights to such materials are transferred to the User.

8.1. The website may contain links to third-party information resources.

8.2. NESF does not determine the content of third-party resources and is not responsible for the processing of personal data carried out by their owners, unless otherwise follows from the legislation of the Russian Federation or from the actual relations between the parties.

8.3. Before using a third-party resource, the User is advised to review its terms and its documents on the processing of personal data.

9. Website Performance and Changes

9.1. NESF may change the content and structure of the website and may temporarily restrict access to individual sections during maintenance work or troubleshooting.

9.2. The Company takes reasonable measures to keep the website operational, but does not guarantee uninterrupted access in circumstances beyond its reasonable control.

9.3. Changes to the functionality of the website related to new methods of personal data processing must be accompanied by updating of the relevant public documents.

10. Final Provisions

10.1. These Terms apply in the version posted on the website.

10.2. When these Terms are amended, the new version is posted on the energystate.ru website.

10.3. Matters not regulated by these Terms are governed by the legislation of the Russian Federation.

10.5. These Terms are a translation of the Russian-language original. In case of any discrepancies between this translation and the Russian version, the Russian version shall prevail.
