Main page > Comments > Fuel & Energy > Ukraine: RUE case sharpening Ukraine: RUE case sharpeningThe Ukrainian prosecutor general's office sent a message to the Moscow Arbitration Court with request to inform Gazprom of the court hearings on a suit against Naftogaz to be held in the Kiev Economic Court on October 21. The process is about examining legality of agreements signed on January 20, 2009 on reselling 11bn cu m of gas - at that time Naftogaz bought out RUE's debts to Gazprom totaling $1.7bn and swapped them for gas supplies. That was a position of Ukrainian authorities represented by then PM Yulia Timoshenko. Now there are new state authorities and the new team headed by Viktor Yanukovich definitely takes much more liking to RUE co-owner Dmitry Firtash. In particular, it is indicative that RUE won a case at the Stockholm arbitration court (Naftogaz was obliged to return 12.1bn cu m of gas to the trader) and now it is trying to strengthen its positions at Ukrainian courts. It should be mentioned that Firtash was one of the main political and economic opponents of Timoshenko; when the latter was in power RUE did not succeed in struggling against Naftogaz. The case looks very confusing even on the Ukrainian national level and it may become more perplexing with attempts to involve Gazprom into it. According to some information, the Russian gas giant is not a respondent in this case. Other sources claim the suit was simultaneously brought against Gazprom and Naftogaz. To some extent these seemingly mysterious and illogical developments are attributed to the struggle for the domestic market between the Ukrainian opposition and state authorities interested in RUE, as well as between groups in Gazprom that have different opinions on how and with whom to organize gas sales on the Ukrainian market.
